This week, we have been thinking about issues like intellectual property, copyright, and plagiarism. In terms of design, the laws on intellectual property are quite difficult to understand. When talking about the copyright of music, it is a big mess and the major record companies don't know what to do about people copying music and sampling it. In terms of copying published words, plagiarism rules are extremely strict and unchanging. Gladwell is asking us, why?
All of us copy, me included. I copy pictures from the internet everyday to prepare presentations. I burn music CDs for my friends. Copying and pasting are pretty routine, and I don't think about it much. However, in the world of academia in which I work and in which you study, it is clear that copying the words of others in research and writing is absolutely unacceptable and punishable. I don't know how to answer Gladwell's question.
In your view, when is it ok to copy Art? Why is it ok to copy some creations but not others? What is your view?

ReplyDeleteArt is the creation from human's mind, and the way people express their feeling. Some how, there are some groups of people that used famous art work as their own property. If there is no permission from the origin work, I called this copy. To think about it carefully, some artist put their soul in their paint and work really hard for it, but in the end, others steal their masterpiece and sell it. However, in some cases, such as copying the picture for the presentation or burn music CDs, I don't think it hurts someone or making other feel uncomfortable. Unlike stealing others work, which is unacceptable and the laws should be strictly use.
It is true that a lot of soul and sweat and tears go into the creation of art. It is often difficult to keep that in mind when we're copying and sharing it for our own use.

ReplyDeleteIn my personal opinion, it depends on the period of time ans the situation owing to two crucial factors. The first one is artists' flexibility. For instance, many artists welcome to show their artworks and allow people to imitate his works because some probably think that it is the way to make them famous. The second one is the purpose of copiers. For example, if someone copies another artwork in order to apply to be his work without permission, it is the time to call that action illegal.
Time matters. You're right. The copyright on some works expires, which is the reason why you can find legal downloads of Shakespeare, Dryden, and Joyce. No one is profiting from that anymore.

ReplyDeleteWell, it is not completely okay with coping others' arts because this is like stealing others' ideas. In some cases, it can be acceptable as some individuals only use others' works to be their model or get the inpiration which it is not imitation and does not create negative effects to the owners. Some might use other people's images or sounds to create an educational content. In contrast, still, the way that people use others' creations is totally not pleasant for the owners. Some individuals use the copies for their own benefits, and majority of them do not get those copies legally. For instance, people can easily download or copy things from internet such as movies, songs or pictures which these actions are against a copyright.
This is really the nature of ideas... they can be used. We get ideas and inspirations from many sources, whether it is something we saw on tv, or heard from a friend, or read in a magazine... the ideas can be used, changed, and manipulated.

ReplyDeleteArt is one of million options for people to show their feeling. In my point of view, it is wrong to copy others’ art work to show as it created by your own idea. I think it does not fair for artists that they spend a lot of times to create their art work, but others can steal it easily. However, if people ask for a permission to use, it is okay.
There is an issue of fairness. And I think this is what the law works to protect. On one hand, we depend on ideas from others to develop our own, but the law works to protect the creative rights of others.

ReplyDeleteIn my opinion, copying is never acceptable in any categories unless you give the owner a credit, art in particular. People use their own idea to create an art work and probably take a lot of time. And it is not fair for someone else to just use it to apply to their own work without asking them or not giving any credit for them.This kind of action can lead to a serious problem such as crime because it is quite a lot like stealing.
You have a very clear idea here. In some ways, this could seem like a black and white issue.
DeleteArt is all the creations that human create. It depends on their thoughts and mine which bring toward their artwork. Some people uses Art as the ways to express how they feel. Currently, there are many pieces of art that literally use the same source. Some people got the idea or the sources from others and turn it into their own work which what we commonly called copying. There are so many copy works exist in the world today, especially music. There are many songs that have the same rhythms, beats, or lyrics. If the music artists did not ask for permission from the original to use the same source, then that will automatically copying. In my opinion, it is not acceptable at all to use the same the source without giving the owner credits. After all, just imagine if you create an art of any kind and someone use your source and turn into their own work. How would you feel?? Definitely not good.

ReplyDeletePersonally, there is no specific answer for these questions. It is quite complicated to answer that when and why that is suitable to copy something. Art always moves parallel to people's thought. Some people are inspired from other arts and adapt those arts to be their versions. For instance, there are many famous cover singers on youtube and some songs are fairly better than the original one. However, no one complains to those cover songs. Conversely, it is severely illegal to copy in academic writing works, plagiarism. In some cases, I think that people do not find their styles to write their own works. For instance, some people might read other books for guiding their work. Therefore, their article quite alike to those books because they are used to with writing style from others. Nevertheless, perspective of people certainly decides what they think.
I think that all these things are flexible.
The harder we look for answers on issues like this, we often only find more questions. I like this comment.

ReplyDeleteIn my opinion, when it comes the word of art, it is difficult to define what art refer to. Music, pictures, handwriting, ideas, or words also called art in majority group. I think in term of ideas and words is unacceptable to copy because it is belong to people who discover or people who begin it. However, there are pictures that are coming from painting, and drawing, I think in this case. It might be some chance that art can be copy because the methods, colors, and paper is similar the same and it does not belong to somebody personally. For example, people make purple by using blue and red. Music is the most difficult thing to see the different and the unique of the sound or key of music's note. Therefore, Music can be considered as can copy, if they use the same key note not the whole songs that someone wrote them.
This is an interesting point. Last week, I asked everyone to define "art,' and many people said that art is everything! Is it? Then, if everything is art, then how could one not copy it?

ReplyDeleteCopying someone's work without giving credit to the owner should be considered a serious crime. Even though you copy just some creations from a piece of work you still should give credits to the original work or the owner of it. It is like stealing someone's idea without asking for permission which may hurt the feeling of original work creators. Regarding the legislation, plagiarism is considered a very serious case that sometimes this kind of problems need to be judged on court. In my view point I feel that if I am an artist and then someone is trying to copy some parts of my work without giving me credits I will never let that person take it for free as he/she steal a piece of work that I put a lot of effort on.
It sounds like you would consider stealing your art or creation the same as stealing some of your physical property like your bag, or car, or money. I wonder if we, as a society, will come to that conclusion eventually.

ReplyDeleteWhen your creating an art piece whilst giving credit to the artist or your not using other peoples art to earn money. For example, using the art piece for educational purposes. Using an exmaple from a person that does this kind of work professionally is a great way to show how it is done. As a student I do my best to reference work that belong to others as it is someone elses interlectual property. Taking credit for ones own creation is taken very seriously and is punishable by failing your course.
I like this. As long as you're giving credit, it should be considered a kind of flattery that someone is using your work. But credit needs to be given. We have certainly made this decision clear in academic work.

ReplyDeletecopying art or copying works of someone is still wrong in my opinion. It does not mean that we aren't able to get any ideas from them. It can also used as a reference and creating that art without using it to steal other credits. Although, everyone have different ideas and someone them can be similar to others, it doesn't mean that you can copy from other people completely. We should respect their creativeness and us these to create more impressive ideas.
Respect is key. But then, when you have the option of buying music or a film or another kind of art, but you can also get it for free quite easily online, how important is respect then in that decision?
